The Deflection Playbook.
Every time the Gaza evidence is laid out, the same six rebuttals arrive to wave it away. We did to the denials what we do to the claims: steelman each, grant what's true in it, then weigh it against the record. Five of six collapse.
Companion to the Gaza-conduct triptych (Dahiya doctrine / Off the Charts / NAZA), which pose the legal verdict as the court's to make. This page turns to the other side of the argument: the recurring deflections used to make that evidence disappear — 'you can't know their intent,' 'they have nukes and haven't used them,' 'human shields,' 'the numbers are inflated,' 'it's self-defense,' 'calling it genocide is antisemitic' — graded the same way, kernel granted before each is weighed.
The result is lopsided and we didn't set out for it: 5 of 6 grade FALSE/MISLEADING; only the human-shields argument rests on something real (→ SOME SMOKE), and even that is overextended. THE DISCIPLINE, up front: showing a defense is weak is NOT proving the charge — it removes the off-ramps and leaves the question with the evidence and the ICJ. We're not sneaking in a verdict. Dual-stance held: antisemitism is real and some deflections guard against real overreach; Oct 7 was a real atrocity; Israel has a real right to self-defense. What survives: the arguments most used to close the conversation don't survive the record.
'You can't know their intent' — FALSE/MISLEADING. The law never required telepathy.
Steelman granted: specific intent (to destroy a group as such) is a genuinely high bar, and much conduct is also consistent with a brutal war on Hamas a court must rule out. But the deflection smuggles a false claim beside the true one. 'A court hasn't finalized the finding' = true. 'Intent is unknowable without mind-reading' = false — courts infer specific intent from the pattern/scale of conduct, who's targeted, and what decision-makers say (settled: Akayesu, Krstić). And there's a record: a defense minister's 'human animals' + 'no electricity, no food, no fuel'; the Amalek invocation; ministers talking openly about emptying Gaza. The ICJ found the risk plausible enough to order Israel to PREVENT genocidal acts, citing those statements. 'We can't see inside their heads' is a refusal to look at what came out of their mouths.
'They have nukes and haven't used them' — FALSE/MISLEADING. A non-sequitur twice over.
Kernel: Israel holds overwhelming force it hasn't maximally unleashed. But: (1) genocide is intent to destroy 'in whole OR IN PART' — never required killing everyone or killing fast, and the Convention expressly counts destruction by 'conditions of life calculated to bring about physical destruction' (siege, starvation, wrecking hospitals/water) — done with a blockade, not a warhead, so 'they didn't nuke it' answers a charge no one made; (2) the restraint has an obvious non-moral explanation — you don't detonate a nuke on land you claim as your own, abutting Tel Aviv and Jerusalem, showering fallout on the territory you intend to hold and settle. Restraint explained entirely by self-interest isn't evidence of mercy. The arsonist who owns the house just doesn't use gasoline.
'Hamas uses human shields' — SOME SMOKE. The one deflection with a real foundation — and it's overextended.
Graded the most generously of the six, honestly. Hamas does operate in dense civilian areas and built tunnels under them; that genuinely raises the civilian cost of lawful strikes, and it's Hamas's moral burden, not a detail to wave off. BUT the presence of a combatant doesn't suspend the attacker's own duties of distinction and proportionality — you may not inflict civilian harm excessive to the concrete military advantage, shields or not, and the shielding party's wrong doesn't transfer the death onto its own ledger. And it can't explain the pattern NAZA + the toll describe: pre-set allowances of 15–20 civilians per junior target, neighborhoods leveled with ~25% of residents inside, the siege/starvation of 2 million who shield no one. 'Fighters were nearby' mitigates some strikes; it doesn't convert a policy of accepted mass civilian death into an accident.
'The numbers are inflated' — FALSE/MISLEADING. The uncertainty runs toward undercounting.
Fair part: the Gaza Health Ministry doesn't fully separate combatants from civilians, so the precise civilian share is contested. But 'inflated' is the wrong direction. Its magnitude figures have been used by the UN and, in past wars, found broadly consistent with independent and even Israeli intelligence estimates; the real-time toll is corroborated by UN agencies. Where independent analysis departs, it argues the true number is HIGHER — Lancet studies estimate large numbers of uncounted dead under rubble + indirect deaths from the collapse of food/water/health. Attacking the counter avoids the count; the magnitude — tens of thousands killed, overwhelmingly on one side, a large share women and children — is not seriously in dispute.
'It's self-defense — Oct 7 started it' — FALSE/MISLEADING as a defense to the conduct. The premise is true; the conclusion doesn't follow.
Premise held firmly: Oct 7 was a real mass atrocity and Israel has a genuine right to defend itself. But as a defense to how the war is fought, it's a category error. Law keeps two questions separate: whether a state may use force (right to go to war) and how it may fight (law of armed conflict). A just cause doesn't loosen a single rule about how you fight — proportionality, distinction, the ban on targeting civilians bind the attacked side exactly as everyone else; otherwise every atrocity could be laundered through the grievance that preceded it. 'They started it' answers why the war is fought, not for a method, a doctrine, or a toll — and no casus belli has ever excused a genocidal intent.
'Calling it genocide is antisemitic' — FALSE/MISLEADING. It collapses on who is making the charge.
Kernel taken seriously: antisemitism is real and 'genocide' is sometimes wielded in bad faith, including by people whose quarrel is with Jews or Israel's existence — we reject that. But as a blanket answer it collapses on the accusers. The ICJ case was brought by South Africa with growing state support. Inside Israel, B'Tselem and Physicians for Human Rights Israel jointly concluded in 2025 that Israel is committing genocide. Omer Bartov — Israeli historian, IDF veteran, a foremost Holocaust/genocide scholar — concluded the same in the NYT. Amnesty concluded it in Dec 2024. An accusation doesn't become bigotry because of the group it names; it's weighed on evidence. When Israeli Jews who study genocide for a living are sounding the alarm, 'it's antisemitic' isn't an argument — it's a way to make the people best placed to judge unspeakable.
The line we hold.
- METHOD: we grade the DEFLECTIONS, not the verdict. Defeating a defense ≠ proving genocide; it clears the off-ramps and leaves the question with the evidence and the ICJ (case live, unfinished). Verdict stays posed.
- FALSE/MISLEADING — 'you can't know their intent': courts infer specific intent from conduct + statements (Akayesu, Krstić); the ICJ cited the record ('human animals,' Amalek) in ordering prevention. 'Hard to prove' ≠ 'unknowable.'
- FALSE/MISLEADING — 'they have nukes, haven't used them': genocide is 'in whole OR IN PART' + conditions of life (siege/starvation); you don't nuke land you claim next to Tel Aviv/Jerusalem. Self-interest ≠ mercy.
- SOME SMOKE — 'human shields': the one real kernel (Hamas does embed in civilians), but it doesn't suspend proportionality/distinction and can't explain pre-set 15–20-civilian allowances or the siege of 2 million.
- FALSE/MISLEADING — 'numbers are inflated': magnitude corroborated by the UN; independent (Lancet) analysis argues UNDERcount. FALSE/MISLEADING — 'self-defense': a just cause to fight doesn't loosen how you may fight.
- FALSE/MISLEADING — 'it's antisemitic': the charge is carried by Israeli human-rights groups (B'Tselem/PHRI), an Israeli genocide scholar (Bartov), Amnesty, and South Africa's ICJ case. DUAL-STANCE: real antisemitism + bad-faith uses exist; Oct 7 real; Israel's self-defense right real — none of which makes an evidence-based charge bigotry.
Why it matters.
Lay the six side by side and one move repeats under all of them: each takes something true and narrow — intent is hard to prove, the Health Ministry doesn't sort combatants, Hamas really does fight from among civilians, Oct 7 really happened — and inflates it into a conclusion it can't carry. The true kernel does the emotional work; the overreach does the exculpatory work; and because the kernel is genuine, the whole thing feels like rigor rather than evasion. That's what a good deflection is: not a lie, but a truth asked to do a job far bigger than its size. Naming that structure is the point, because it's portable — the same move defends every powerful institution we cover, a true fact about complexity standing in for the missing defense on the merits. The counter is always the same: grant the kernel out loud, then measure the gap between what it proves and what it's used to prove. And then the discipline, one more time, because it's the whole credibility of the project: clearing the excuses is not rendering the verdict. We haven't proven genocide here and haven't tried; we've shown the usual reasons for not looking don't hold — a smaller thing, and a necessary one, because a question this grave should be closed by a court weighing evidence, not by a phrase that ends the conversation before the evidence is read.
Help us fill these lines.
- OpenThe ICJ's eventual merits ruling in South Africa v. Israel — the finding that will actually adjudicate what these deflections try to pre-empt.
- OpenA like-for-like test the deflections would have to pass to count as rigor rather than special pleading: would the same argument be accepted in defense of a past atrocity now universally recognized?
- OpenThe disputed specifics the strongest deflection leans on (which strikes had a lawful military objective proportionate to the civilian cost) — resolvable only against operational records neither side has fully disclosed.
